Plain terms, written to be read. They describe what you get, what it costs, how to stop, and what happens to your photos — in the same language the app uses.

1. Who you're dealing with

SurfSort is provided by Innovation Anywhere OÜ, a limited company registered in Estonia (registry code 17010770, VAT number EE102749214), Sepapaja tn 6, 15551 Tallinn, Harju maakond, Estonia — "we" or "us". By creating an account or using the app you agree to these terms.

2. What SurfSort is

A macOS app that sorts a surf session's photos into folders by person. The sorting runs on your Mac. You can sort with no internet at all — the app does the whole job on your machine and puts the waves it cannot place in a "To check" folder — or you can add our AI, which checks the folders and settles those waves for you. You need macOS 14 or later and an Apple silicon Mac. You need an internet connection to sign in and to use the AI, not to sort.

3. Your account

You need an account to use SurfSort. Keep your login details to yourself; you are responsible for what happens under your account. One account is for one person — don't share it. Give us a real email address, because that is how we reach you about your subscription.

4. Free trial

New accounts get 3 free sorting sessions, and each one can hand up to 3,000 photos to the AI. Sorting on your Mac has no photo limit at all, on the trial or on any plan. Point SurfSort at a bigger folder with the AI switched on and it tells you before it starts, without using up a free session — so you can sort it on your Mac instead, or pick a plan. The free sessions are counted per session, not per photo: a session of 50 photos uses one, the same as a session of 3,000.

Trials are per person and per computer: a Mac that has used its free sessions cannot get more by making new accounts. After that you need a subscription to keep sorting, and plans have no limit on the size of a single sort.

5. Plans and payment

Sorting on your Mac is unlimited on every plan. What a plan buys is how many photos the AI may look at in a month.

Above 200,000 AI photos a month, write to us and we will quote you.

All prices are in US dollars and exclude any VAT or sales tax, which is added at checkout where it applies. A yearly plan costs the same as ten months.

7. Your right to change your mind (EU/EEA consumers)

You normally have 14 days to withdraw from a distance purchase. Because SurfSort is digital content supplied immediately, when you subscribe you ask us to start straight away and acknowledge that you lose that 14-day right once we do. If you would rather keep the right, wait 14 days before sorting.

8. Your photos are yours

You keep every right in your photos. We claim nothing in them. We do not use your photos to train AI models, and neither does Anthropic on our behalf. You confirm you have the right to process the photos you sort — including, where the law requires it, the right to use pictures of the people in them.

9. What we ask of you

Don't resell, rent out, or share your account; don't take the app apart or try to get around its limits; don't try to break into our servers, other people's data, or the AI relay; don't use SurfSort against the law or to process photos you have no right to; don't be abusive on the requests board. We can suspend or close an account that does these things.

10. Honest limits

On the sessions we measured while building SurfSort, it sorted 81–96% of a session's photos correctly on its own, and reached 99–100% after answering a handful of its questions. Those are measurements on our own photos, not promises: SurfSort will sometimes put a photo in the wrong folder, or ask you a question it should have known the answer to. Always check the result before deleting anything. SurfSort moves files on your Mac, and you can undo a sort from inside the app, but you are responsible for your own backups.

The service is provided "as is". We do not promise it will be uninterrupted or error-free, and we depend on third parties (Anthropic, Supabase, Stripe) whose outages will sometimes be ours.

11. If something goes wrong

Nothing here limits liability for death, personal injury, fraud, or anything else the law says cannot be limited, and it does not affect the statutory rights of a consumer.

Otherwise: we are not liable for indirect or consequential loss, lost profit, or lost data, and our total liability to you for any claim is capped at what you paid us in the 12 months before it arose.

12. Ending things

You may stop at any time (section 6). We may end your access if you break these terms, or if we discontinue SurfSort — in which case we will give you reasonable notice and refund the unused part of what you have paid.

13. Updates to the app and to these terms

The app updates itself; some releases are required for it to keep working. If we change these terms materially we will tell you before the change takes effect, and continuing to use SurfSort after that means you accept them.

14. Law and disputes

These terms are governed by Estonian law, and the courts of Estonia have jurisdiction. If you are a consumer, you keep the protection of your own country's mandatory law and may use the EU's online dispute resolution platform.
